These Terms of Service ("Terms") govern your use of the Never Miss A Lead website and services. By accessing or using our website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Services

Never Miss A Lead provides AI-powered lead generation and customer communication services, including but not limited to:

• AI voice receptionist services
• AI website chat services
• Lead qualification and management
• Calendar booking and scheduling automation
• Related consulting and support services

2. Service Agreement

The specific terms of your service engagement, including pricing, features, and service level commitments, will be outlined in a separate Service Agreement or Order Form. These Terms supplement but do not replace your Service Agreement.

3. Pricing and Payment

Pricing

Pricing for our services is as displayed on our website or as agreed in your Service Agreement. We reserve the right to change our pricing with 30 days' notice to existing customers.

Payment Terms

Monthly fees are billed in advance. There are no setup fees. Payment is due within 14 days of invoice date. Late payments may incur interest charges and service suspension.

4. 30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee on our services. If you're not happy with our service for any reason within the first 30 days, simply contact us and we'll provide a full refund of monthly fees paid, no questions asked.

To request a refund under this guarantee, submit your request in writing to legal@nevermissalead.co.uk within 30 days of service activation.

5. Service Term and Cancellation

Term

Services are provided on a month-to-month basis unless otherwise specified in your Service Agreement.

Cancellation by Customer

You may cancel your service at any time with 30 days' written notice. You will be responsible for payment through the end of the 30-day notice period. Refunds are not provided for partial months.

Cancellation by Never Miss A Lead

We reserve the right to suspend or terminate services for non-payment, breach of these Terms, or if we determine that continuing service would violate applicable laws or harm our business reputation.

6. Your Responsibilities

You agree to:

• Provide accurate and complete information about your business
• Use our services in compliance with all applicable laws and regulations
• Not use our services for illegal, fraudulent, or abusive purposes
• Maintain the security of your account credentials
• Notify us promptly of any unauthorised use of your account
• Respond to customer enquiries captured by our AI services in a timely manner

7. Intellectual Property

All content, software, and materials provided as part of our services remain our property or the property of our licensors. You are granted a limited, non-exclusive, non-transferable licence to use our services for their intended purpose.

Any custom AI configurations, scripts, or materials created specifically for your business will be jointly owned, with you retaining rights to use them with our services.

8. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. You retain ownership of all customer data captured through our services. We will not sell or share your customer data with third parties except as necessary to provide our services or as required by law.

9. Service Level and Uptime

While we strive for maximum uptime, we do not guarantee uninterrupted service. Our services depend on third-party infrastructure (internet, telephony providers, cloud services) which may experience occasional outages.

Specific uptime commitments, if any, will be detailed in your Service Agreement. We are not liable for service interruptions caused by factors outside our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law, Never Miss A Lead's total liability for any claims arising from these Terms or our services shall not exceed the total fees paid by you in the 12 months preceding the claim.

We are not liable for:

• Indirect, incidental, special, or consequential damages
• Lost profits, revenue, data, or business opportunities
• Errors or inaccuracies in AI-generated responses
• Customer dissatisfaction with leads captured by our services
• Third-party service outages or failures

11. AI Service Disclaimer

Our AI services use advanced technology to communicate with your customers. While we strive for accuracy and professionalism, AI-generated responses may occasionally be imperfect or misunderstand customer enquiries.

You acknowledge that AI technology has limitations and agree that we are not liable for any miscommunications or errors in AI responses. You are responsible for reviewing captured leads and following up appropriately.

12. Indemnification

You agree to indemnify and hold harmless Never Miss A Lead from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website. Your continued use of our services after such notice constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with your Service Agreement and our Privacy Policy, constitute the entire agreement between you and Never Miss A Lead regarding our services.
